for the first time in its 200 year history, the united states postal service will default with a $5.5 billion payment to the u.s. treasure. and that default will happen tomorrow. >> the postal service has been required to make payments to front future retiree health benefits. the payments are scheduled through 2016 and were mandated by congress back in 2006. the default won't cause any kind of short term failure. but analysts point to long-term

harm as the mail agency finds itself preoccupied with staving off bankruptcy. in april, the senate passed a bill that eased the retiree payments by stretching them out over time. the bill gave the postal service access to much-needed cash, an $11 billion overpayment in the employees' retirement system. but the republican-led house has yet to consider the bill. >> the mail service is considered independent, it does not usually use taxpayer dollars. currently it is operation on a $12.7 billion loan from the treasure. gore vidal passed away tonight at the age of 86.

he died in los angeles of complications from pneumonia. he has been living alone and had been sick for some time. he was known for such best-selling novels as myra beckenridge. in the 1960s and 70, he was a fixture on talk shows and other television programs. the oakland police department faces the threat of a federal takeover. a court-appointed monitor says the city has not moved quickly enough to implement the reforms the court has required. >> reporter: this report indicates the police department is still not in compliance with court-ordered reforms, and the fact remains behind almost stagnant. supervision and the review of work by officers remain of concern, andbout the - raised about the police response to occupy oakland, some

officer-involved shootings, and the department response those raise even greater concerns >> i don't believe they believe these reforms are necessary. >> reporter: this is one of the attorneys that filed the original lawsuit that led to these reforms >> the supervisions, the prigzs, the people who -- the politicians, the people who are responsible for the systemic dysfunction in the police department are never held accountable. >> reporter: the report also indicates photos posted inside police headquarters of a federal judge, possibly the one on this case, and an elected city official, possibly the mayor, had been defaced in a manner found to be "racist, insulting and inappropriate." >> the cultural change that they're talking about has not occurred. they have contempt for this process, and in my view, a number of them have contempt for the people of oakland. >> reporter: for her part, oakland mayor jean quan issued a

statement saying "receivership for the oakland police department is not an option. she went on to criticize the monitor's report saying it lags up to six months behind reality and said "we are now down to nine tasks remaining from an official 55 tasks kwtsd >> the fact they've done a few things over nine years doesn't -- pales in comparison that they have not done the core issues that are the very heart of the nsa. >> reporter: he says they're not in favor of a federal takeover, but if things don't dramatically improve in the next few month, file papers asking for a federal takeover. >> if the federal government does decide to take control, it could bring big changes to the oakland police department. charles clifford spoke with a former san francisco police chief about what a federal takeover could mean for opd.

>> reporter: former san francisco police chief tony rubarrow says when it comes to a federal takeover, the judge handling the case has the final say >> he will be the one who will say this is federal law that you have to comply with. >> reporter: but what would a federal takeoverlook like? >> hypothetically you hire 200 more officers within a six-month period, hire outside investigators for investigation of officer misconduct. putting somebody in the administration of the police department to insure compliance on a day to day basis. >> reporter: he also says the judge could bring in other agencies to help out. >> it's possible that judge henderson could decide that part of the oversight be from the justice department of the >> reporter: he says it's too early to know for sure what the judge might decide to do, but he hopes if need be, the city of oakland and the police department can make it work.

san jose police say they have arrested three people after a series of robberies near a high school on monday night. officers were called after several people were robbed by the men about 11:00 last night

near evergreen valley high. the three suspects were arrested after a yard to yard search of the one of the men was armed with a mack 10 automatic weapon. two children are alive after jumping from a moving car. their stepfather is behind bars after reportedly trying to drive his family off a cliff. he was driving with his wife and two step children on highway 101 in mendocino. he told everybody in the car he intended to kill them after an argument. two children opened the door and jumped out of the car.

power has been restored across india! that's after a major system collapse led to the worst blackout in history. an estimated 620 million people were without power after india's northern, eastern, and northeastern grids failed. workers restored most of the system in the hours after the crash. the government has ordered an investigation into what caused the crisis there. the fight over same-sex marriage may be headed to the u.s. supreme court. supporters of prop 8, the california voter-approved ban on same-sex marriage petitioned the highest court in the nation to take up

the case. as kate thompson report, this is the latest step in a long, drawn out legal battle. >> reporter: this fall the supreme court will decide whether or not it will take on the case of same-sex marriage. >> this is a court that likes high-profile cases. and this is an issue that has split the country. there are some states doing it and others that are not, there are some states that have banned it and some who have authorized it. that's the kind of case the supreme court is attracted to. >> if the supreme court decides not to hear the case, that's the end of the story for proposition 8. it gets wiped off the books. >> reporter: proposition 8 has been declared unconstitutional twice. despite the rulings, the ban on same-sex marriage has stayed in place while the appeals process is ongoing. if the supreme court decides not to hear the case, the earliest rulings would stand and strike down proposition 8 and same-sex marriages would rule.

one of san francisco's popular vietnamese restaurants has been shut down because of numerous health violations. it's the not first time it has been forced to temporarily shut down due to unsanitary conditions. reggie kumar tells us how the owner plans to reopen. >> reporter: health officials say they found mice inside the restaurant, cockroaches in the cooking areas, and workers forgetting to wash their hands. those are just some of the health violations. the notice on the door issued by the department of health says the restaurant is closed due to serious and repeated violations. right next to it, the owner put up his own note, which reads "we will reopen in three weeks. we are making major improvements for your comfort and amusement." but past customers say they are not amused about the establishment's unsanitary conditions >> i got food poisoning.

into about 12:00 pm, it looks like the 50s and 60s will be out of our hair. warm conditions by lunchtime, 70s, 80s, and even some 90s. by 3:00 pm, the highs, that red starts to fill in here, indicating 90s for your warmest inland areas. sunnyvale could reach 80 degrees, 88 on tap for those of you in los gatos. the 90s, antioch, fairfield, walnut creek. and along the east bay shore line, 70s here. your kron4 around the by forecast shows high pressure in place the next couple days, meaning 90s not much change for your warmest areas. 70s around the bay, and upper 60s for the coast. and a significant cool-down transitioning into the weekend.

here's a look at the tech headlines of the day. mitt romney is going high-tech to announce who will be his vice president. he launched a new mobile application call ed mitt's vp. it will send a notification to users when the candidate is ready to announce his vice presidential the selection. the app would be the first official distribution channel for the big reveal. in other news, mike soft has radically changed their e-mail service hotmail. it's now called outlook. microsoft claims this is a major improvement to hotmail. it's a fresh, intuitive design that works with office and skydrive, their cloud service, and connects people to facebook, twitter. microsoft will be incorporating skype into the e-mail service. you get free word, excel, and powerpoint word apps built in. in legal tech news, zinga has been hit with a

class action lawsuit. they make social networking type games like farmville. the lawsuit claims the executives knew the company was struggling when they sold millions of shares before announcing a directed drop in earnings. their stock is down 70% from its ipo price at $10 set nine months ago. police are investigating a double shooting that killed one person and left another injured in san francisco tonight. the shooting reportedly happened shortly after 10:00 pm in the 3,000-block of san bruno avenue. the injured person was transferred to san francisco general. the person's condition is unknown at this hour. the a's take on the rays while the giants battle the mets. and speaking of the

tim lincecum had it going again tonight! an up and down season, mostly down for lincecum. went in his favor this evening. the giants, bases loaded, mets up 1-0, crawford grounds into an apparent double play, but no!
